Additional text:HELD VIA ZOOM Plaintiff appears by Attorney Kendrick Yandell Defendant appears by Attorney Brinton J Resto and Attorney Brian Christopher Spahn Matter before the Court on plaintiff's motion to dismiss, and defendant's several motions. Court hears statements from the parties. As to plaintiff's motion to dismiss, the Court finds that there is agreement by the parties to dismiss in principal. Based upon hearing held with respect to additional motions presented by defendant, the Court orders briefing by the parties. Defendant-movant shall file relevant briefs/motions on or before 02/23/2024; and Plaintiff shall file responses on or before 03/18/2024. Replies permitted only with permission from the Court. Court VACATES pretrial scheduled for April 15, 2024. Court will take filings under advisement and issue a written decision by 05/02/2024. No further activities scheduled by this Court at this time.
