As Rick is accusing them of using excessive force and being dicks about the whole thing, it would benefit the cops to keep the footage sealed, but it would benefit Rick to release it. Can the footage be included in the evidence and not made public just because Rick doesn't want us to see it?

I skimmed through the brief on KF, and I'm a below-average idiot who has seen a couple episodes of Suits, but my two takeaways from it were:

1. The judge still sees Rick as a special WHYUS boy and perfect little angel who is never to blame for anything. Which tbf the MPD needs to prove but I guess they figured qualified immunity would be all they needed. The judge seems to conclude that Patrick was a bit frustrated but otherwise respectful and calm during all these interactions, thus the officers had no probable cause to search his property. The reality is he was belligerent, probably drunk, screaming threats at the officers and lunging at them.

2. The case seems mostly to be about the officer's prior awareness that this was a "swatting location", which is why the first count was dismissed. The issue is if the police ever went "hey another call to that Tomlinson prick's house, let's go over and fuck with him again". But I'm not sure how Patrick intends to prove this is the case unless some idiot cop said so much while wearing a bodycam. If all Patrick has is his narcissistic "I know what everybody else is thinking and don't have to prove anything" reasons as to why the police were targeting him, his case is dead. As it is, Satistfy Monell has become the new Satisfy Krinsky, and once again I don't see any reasonable way how Rick could get satisfaction.

I’m spitting nails that Pat’s emailed claim that he was too tough to cuff got accepted and put in a legal document. It’s obviously gaytarded and not important but it still annoys me.

For the record, Richard: The cops demonstrated that they are well-trained professionals of good judgment when, rather than using force to restrain you seconds after you screamed a million-dollar lawsuit threat, they let your flabby, weak body continue to jiggle free. They saw clearly what you were trying to do and did not play into your bullshit. Get fucked. I hope it’s what loses you the lawsuit.

MPD's lawyers really need to prove Rick was belligerent and they simply haven't yet. Rick's always going to claim to be perfect and blameless and you're right, the judge will have to take that at face value and consider the case through that lens.

That's why qualified immunity wasn't automatically evoked, because the case as presented is a calm and rational Patrick going "c'mon guys, this again?" The judge even brings up multiple examples of police interfering when they go to a domestic violence call and can tell the wife is being threatened to say everything is fine and she can't remember why she called 911.
