I highly doubt Resto assured them he’d get even Quasi’s name, let alone all 60 names. Every lawyer I know is very cautious with what they say to their clients. The play was always to scare Quasi into yielding, which works probably 90% of the time.

Brinton was completely unprepared when Quasi fought back and took it to Cali, hence the gamesmanship comment. He basically was saying “my shit rarely gets this far so I’m figuring it out the best I can. I’m not even licensed in CA.”

I think Brinton’s a relatively smart guy - he probably recommended to drop it and Patrick refused because he’s a douchebag.

Even if he did say he’d unmask people, you’d have to be a 1.7 (1.2 adjusted) GPA to believe him. Maybe someone should try to get Mary Forehead’s HS transcripts?

I asked one of my lawyer friends why they didn’t consider going into defamation defense since it’s basically impossible to lose - he said the cases get dismissed way too early in the process to ever make any money.

Unless you’re representing Hulk Hogan, it’s not worth your time.

Patrick even said in Tape #2 I believe that from the beginning before they even filed that Brinton said it was going to be a very difficult case to win, yet still worked with him for the money. That was probably his way of saying that he shouldn't try to sue people on the internet. It's very likely that Brinton wasn't the first lawyer who told him this too as the others probably refused to take the case.

The thing is with defamation cases you have to prove how the statements somehow cost you money or losses which is very hard to prove. Even if Patrick was able to get someones identity he'd still have to prove how that said person cost him money.

Yes, America is litigious and yes, you can sue people for being mean to you but it seems pretty rare.

My guess is the majority of civil cases are divorces, custody battles, contractual disputes, personal injury, etc. Basically anything you can prove damages for.

Patrick filed a case that is A) hard to prove damages for and B) challenges the fucking First Amendment - something so important that the Founding Fathers decided to list it first on the Constitution. Good luck with that, Pat.

You’d only sue a bunch of anonymous internet trolls for defamation if you graduated high school with a 1.7 (1.2 adjusted) GPA.

...but they'd fixed that Goodreads problem without spending a nickel; and I think most people who aren't a bit Pat-in-the-head know not to feed the trolls.

Besides, early on they successfully got Null from Kiwifarm's details via subpoena (even though they are publicly available) and that win didn't benefit their members at all; there are still (somehow) mean people on the internet. Once Quasi handed over the logs showing that this place doesn't store shit, and anything it does store is just Cloudflare proxy IPs and rape allegations against Pat's lawyer, the SFWA should have bailed out of the case and saved their money. Pat had to break legal privilege to get SFWA's money and hand over all of his records about the case; their Super Lawyer should have bailed out at that point rather than hanging in and outspending Quasi by 3x (5x?) for nothing more than they got out of Null.

....holy shit, SFWA's lawyer just billed $6k worth of research reading about the case; that means the SWFA staff didn't tell him about it, breaching their guidelines on legal aid.

That's bad; if they've handed out $100k without that basic mandatory check in place it's likely they've broken more rules and given it as a no-strings-attached gift.

It makes me wonder how many other times its happened.

They probably want their members to at least know that they "put up a fight" when their member's info was requested, also they are still under the delusion that not everybody knows that they just flushed $100,000 down the toilet by giving it to a brand new member (who is a straight white male) for free even though the official policy is that members must pay those back.
