btw the cases he's referring to have to do with "product" liability so it doesn't fall under section230 or free speech. If he means to blame kiwifarms, who he has blamed in the past then he'd have to sue xenforo as they produced the kiwifarms forum software. Thats what happened in the snapchat case from a while ago.

Further, the Complaint states Gendron became aware of this concept from information and posts on defendants platforms. Defendants would contend that this “theory” is third-party content/speech and as a result, Section 230 of the Communications Decency Act (CDA) and the First Amendment preclude the plaintiffs’ claims for damages. Plaintiffs acknowledged the protections afforded to the defendants by the CDA and the First Amendment and instead contend the defendants’ platforms are negligently, defectively and harmfully designed “products” that drove Gendron to specific materials and that they are therefore liable.

Yeah its extremely stupid, but a clever way around getting tossed at the onset due to the CDA. As far as I can tell that's all that's happened. It gets around an initial motion to dismiss on 230 grounds, but that's just the minimum prima facie burden (the one Rick couldn't overcome). I doubt it goes anywhere, but who the fuck knows.
