Ever since Brandon Lee’s death filming The Crow, Hollywood stopped being quite so retarded and the prevailing wisdom was to treat blank firing guns as real weapons. In other words they NEVER get pointed at another person loaded or not. You have a non firing replica for scenes where someone needs a gun pointed at them and you fake the rest. Anyone not doing this does deserve to be charged for any injury they cause to someone else. Furthermore Alec Baldwin is not some new actor, he would have received literally hundreds of safety briefings on numerous productions over the course of his career. The live rounds is sheer incompetence but the way you film these things is by following the 4 rules of firearm safety. In other words at any time a live round should be able to be substituted with no loss of life or injury.

TL;DR: completely preventable death and everyone involved should go to jail.
Even more foreboding for Alec is the fact that there are two paths to finding him guilty under NM law for manslaughter, and the jury doesn't have to pick 1. Half the jury can think he's guilty for 1 reason and the other a different reason.

It’s regarded as bad practice in criminal trials. Usually nothing good can come of it.
Jurors are explicitly forbidden from drawing negative inferences from a defendant's decision not to testify in their own defense, yet they do it anyway. Sometimes they admit to it and the BS conviction is upheld (see: Derek Chauvin). Hence the reason why a huge percent of defendants do it anyway, and sometimes their attorney's recommend it.

True, most people don’t understand the concept of how not opening your mouth is the best course of action when dealing with legal issues (🐖). I like how they make characters look guilty when they immediately lawyer up in crime dramas.
