Yeah, it's a stupid situation to lose a life over, but the fact the driver didn't shoot until the moment of the still I posted, you'd hope the driver doesn't get charged.
I don't know about the law there, but it seems reasonable that the driver believed (in less than a second) that the gun had been raised to firing position, he had no way to know the gun-hand had been swapped.
