The California subpoena was just one component of the Wisconsin lawsuit. The Wisconsin lawsuit was never thrown out. It was continued to allow Presto Resto to come up with some names from the California subpoena. But since nothing came from the California subpoena, the case will either be continued again on January 20th or it will be dismissed without prejudice, depending on how moody Judge Fudge is on that day, and depending on what Brinton "Give it a" Resto and his fat client's plans are going forward. If it's thrown out, it will essentially be the last nail in the coffin for Rick, but since it would be without prejudice, there's nothing really stopping him from filing suit again.
