If you go on a train and start threatening to murder people, don’t be surprised when someone takes you seriously and restrains you. He obviously never meant to kill him but it’s allowed in self defence without going overboard, which he didn’t. He stopped restraining him when he wasn’t a threat. This is patently fine to do.

He was charged because Alvin Bragg saw an opportunity to race bait. Penny didn't even kill him Neely had a pulse when police arrived but they didn't do anything to try and help him because they saw he was a bum and didn't want aids (actual testimony from police)

Cops aren’t EMT’s though. I don’t know a single cop who would give mouth to mouth to anyone outside of their family and especially not a hobo.
